Request to Issue a Notice or Breach

Under the Strata Titles Act of WA, it is the Strata Companies (all owners) responsibility to enforce the By Laws, control and manage the property for the benefit of all owners, this duty is delegated by the Strata Company to the duly elected Strata Council.

 

Duties of Strata Companies and the registered lot proprietors responsibility to carry out the following, the registered proprietor is unable to remove themselves from a legal liability of property ownership – i.e. they cannot pass responsibility to their property manager. Registered lot proprietors are to repair and maintain their lot and keep it in good state of repair and carry out all work that may be ordered by any competent public authority or local government to be done in respect to their particular lot. Maintenance of the common property, if any, is the responsibility of the strata company and should be arranged by the strata council and paid for from levies collected by the strata company. They may be required to maintain common property for which they have exclusive use.

 

The Strata Company through the strata council are to see that all occupiers and other residents of the Premises are bound to comply with the Strata Titles Act (WA) 1985 and the Notification of Change of By Laws document lodged against the Strata Company and noted within the Strata plan. (meaning they the lot proprietor is to see that the occupiers and residents abide by the by laws at all times)

 

Registered proprietors are to ensure that pursuant to section 45(3) of the Strata Titles Act (WA) 1985, a lease of a lot shall be deemed to contain an agreement by the lessees that they will comply with the bylaws of the Body Corporate

In accordance with the Strata Titles Act of WA it is the Registered lot proprietor of the Premises responsibility to see that;

 

a) occupiers and other residents of the Premises are bound to comply with the Strata Titles Act (WA) 1985 and the Notification of Change of By Laws document lodged against your Strata Company and noted within your Strata plan. (meaning they the lot proprietor is to see that the occupiers and residents abide by the by laws at all times)
